• Loan terms, service fees, and redemption rights are defined in the written agreement signed by both parties
• Monthly loan fees cover the cost of capital, insurance, and secured storage of pledged property. 
• Failure to make required payments may result in default and forfeiture of the pledged collateral as permitted by Florida law. 
• After statutory deadlines and grace periods, unredeemed collateral may be disposed of or sold in accordance with applicable regulations.
   

Xammany Luxury maintains transaction records and client identification in accordance with state regulatory requirements.

TERMS AND CONDITIONS

1. Introduction

These Terms and Conditions (“Terms”) govern the use of services provided by Xammany Luxury Consulting Company (“Xammany Luxury,” “Company,” “we,” or “us”).

By accessing our website, requesting an evaluation, or entering into any transaction with the Company, the client (“Client,” “you”) agrees to be bound by these Terms.

2. Nature of Services

Xammany Luxury operates as a private luxury asset advisory and collateralized lending company specializing in:

• Fine jewelry
• Luxury watches
• Diamonds and gemstones
• Precious metals
• Select high-value luxury assets

Services may include:

• Asset evaluation
• Direct purchase offers
• Consignment advisory
• Buy-back structured transactions
• Collateralized loan agreements

All services are conducted by private consultation or appointment.

3. Asset Evaluation

Asset evaluations provided by the Company:

• Are estimates based on market conditions at the time of review
• May rely on visual inspection, documentation, and authentication
• Are not formal insurance appraisals

Final valuation may change after in-person inspection, authentication, or market verification.

4. Buy-Back Loan Structure

Where applicable, the Company may structure transactions commonly referred to as buy-back agreements or collateralized loans.

Under these arrangements:

1. The Client pledges a luxury asset as collateral. 
2. The Company provides funding based on the assessed value. 
3. A monthly loan fee applies for:

• capital usage
• insurance coverage
• secured storage

Upon full repayment of the principal and agreed fees, the pledged item will be returned to the Client.

All terms are governed by the written agreement executed between both parties.

5. Payment Terms

Clients agree to the following payment obligations:

• Monthly loan fees must be paid on the due date specified in the agreement. 
• Late or missed payments may result in default status. 
• Grace periods, if any, are defined in the signed agreement.
• Wire transfers or payments processed after bank cut-off times may be credited the next business day. 

Payment instructions will be provided in writing.

6. Default and Forfeiture

Failure to make required payments may result in:

• Account default
• Termination of redemption rights
• Forfeiture of pledged collateral

Disposition of unredeemed property will occur in accordance with the Florida Pawnbroking Act and the executed loan agreement.

7. Client Representations

By entering into any transaction, the Client represents that:

• They are the lawful owner of the pledged asset.
• The asset is free of liens or undisclosed claims.
• All provided information is accurate and truthful.
• The Client is at least 18 years of age. 

Providing false ownership information may result in termination of the transaction and possible legal reporting.

8. Storage and Insurance

All pledged collateral may be stored in:

• secured bank vault facilities 
• insured storage environments 

Insurance coverage is maintained during the loan term subject to the limits and conditions described in the agreement.

9. Confidentiality

Xammany Luxury operates with strict discretion.

Client identities, transaction details, and asset information are kept confidential except when disclosure is required for:

• regulatory compliance
• insurance coverage
• payment processing
• law enforcement requests

10. Limitation of Liability

To the fullest extent permitted by law:

Xammany Luxury shall not be liable for:

• market value fluctuations
• loss resulting from inaccurate client information
• delays caused by financial institutions or third parties

Liability shall not exceed the contractual amount defined in the executed agreement.

11. Website Use

All content on www.xammany.net is provided for informational purposes only.

Users may not:

• copy or reproduce website content 
• use branding or trademarks without permission
• misrepresent the Company’s services

Unauthorized use may result in legal action.

12. Regulatory Compliance

Transactions conducted by Xammany Luxury may be subject to:

• state regulatory reporting
• identity verification procedures
• anti-money-laundering compliance

Clients may be required to provide government-issued identification and documentation verifying ownership of assets.

13. Governing Law

These Terms and all transactions conducted with the Company are governed by the laws of the State of Florida.

Any disputes shall be resolved in the appropriate courts located in Florida.

14. Amendments

Xammany Luxury reserves the right to update these Terms at any time.
Updated versions will be posted on the website with a revised effective date.
