LOAN STRUCTURE
What Is a Buy-Back Loan?
Buy-Back Loan allows a client to access funding using a valuable item such as a luxury watch, fine jewelry, diamond, or precious metal as collateral.
The process works as follows:
- The client temporarily leaves the item with Xammany Luxury for secure storage and insurance.
- Xammany Luxury provides funding based on the item’s current market value.
- The client keeps the option to buy back the item by repaying the loan amount and agreed loan fees.
If the loan is fully repaid, the item is returned to the client.
for example:
A client pledges a Rolex watch as collateral.
Loan Amount: $10,000
Monthly Loan Fee: $800
If the client repays:
$10,000 (loan amount) + applicable loan fees
the Rolex watch is returned.
The client may redeem the item at any time during the loan period by paying the balance owed.
Why There Is a Loan Fee?
A client pledges a Rolex watch as collateral.
Loan Amount: $10,000
Monthly Loan Fee: $800
If the client repays:
$10,000 (loan principal) + $800 (loan fee)
the Rolex is returned to the client.
The client maintains control because the item can be redeemed at any time during the loan term by paying the required amount.
Why Is There a Monthly Loan Fee?
The loan fee covers:
- Use of the capital
- Insurance protection for the item
- Secure storage
- Administrative and compliance costs
All terms are fully disclosed in the written loan agreement before the transaction begins.
Payment Schedule — Prorated to the 15th of Each Month
To maintain consistency for all clients, all loan fees are due on the 15th of each month.
If a loan starts on a date other than the 15th, the first payment is prorated to cover only the number of days until the next 15th.
Best example is rent payment:
Loan Start Date: June 5
Next Payment Date: June 15
The client pays a prorated loan fee for the 10 days between June 5 and June 15.
After that:
Full monthly loan fees are due on the 15th of each month until the loan is paid off.
PAyment Structure
Loan Payoff
The loan may be paid off at any time.
To redeem the item, the client pays:
- The remaining loan balance, and
- Any loan fees due up to the payoff date
Once payment is completed, the item is returned to the client.
Late Payment — Florida Pawnbroker Law
Under Florida Pawnbroker Law (Chapter 539), a 5-day grace period is allowed after the payment due date.
Example:
Payment Due: July 15
Grace Period Ends: July 20
If payment is made within the grace period, the loan remains active.
Missed Payment
If payment is not made after the grace period:
The loan becomes past due.
However, the client may still redeem the item during the statutory redemption period, as long as the full amount owed is paid before forfeiture.
Default
A loan may enter default if:
- Loan fees are not paid
- The loan term expires
- The agreement terms are not followed
Default means the loan is no longer in good standing but may still be redeemable during the allowed period.
Forfeiture (Florida Law)
Under Florida Statute Chapter 539, the client has 60 days from the loan due date to redeem the item.
If the loan and fees are not paid within this period:
The collateral is considered forfeited.
Ownership of the item legally transfers to the lender.
Example Timeline
Loan Fee Due: July 15
Grace Period Ends: July 20
Final Redemption Deadline (60 days): September 13
If the loan is not redeemed by that date, the item becomes the lender’s property.
Transparency
Before any loan begins, clients receive:
- A written agreement
- Clear payment schedule
- Loan fee disclosure
- Florida pawnbroker statutory notices
The goal is clear expectations, transparency, and no surprises.
